Important: VelociPost uses artificial intelligence to generate content. AI-generated outputs can be inaccurate, incomplete, misleading, biased, or otherwise unsuitable for your intended use. You are solely responsible for reviewing, editing, approving, and verifying any content before publishing or relying on it.

These Terms of Use (“Terms”) govern your access to and use of the VelociPost mobile application, website, and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms also include VelociPost’s Fair Use Policy. If there is a conflict between general marketing language about “unlimited” use and these Terms, these Terms control.

1. Eligibility and App Store Terms

You must be legally capable of entering into a binding agreement in your jurisdiction to use the Service. If you are using the Service on behalf of a company, brand, or other organization, you represent that you have authority to bind that organization to these Terms.

If you obtained the app through the Apple App Store, your use is also subject to applicable Apple usage rules and policies. Apple is not responsible for the Service itself, including its content, maintenance, support, warranty claims, or claims relating to the Service, except as required by applicable law.

2. License to Use the Service

Subject to these Terms, VelociPost grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own internal personal or business content creation purposes. You may not rent, lease, sublicense, resell, reverse engineer, or exploit the Service except as expressly permitted by law or by VelociPost in writing.

3. Free Access, Paid Plans, and Subscriptions

VelociPost may offer a limited free tier and one or more paid subscription plans. As currently offered in the app, free users may receive a limited number of lifetime generations and a limited number of free refine prompts per generated post, while paid users may subscribe to VelociPost Pro on a monthly or yearly basis. Current pricing, features, quotas, and plan details are displayed in the app and may change from time to time as permitted by law.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Payment is charged to your Apple ID account at confirmation of purchase. You can manage or cancel subscriptions in your App Store account settings. If you restore a purchase, access will be restored according to Apple’s subscription ownership and entitlement records.

4. Fair Use Policy

VelociPost Pro may be marketed as unlimited for normal use. In these Terms, “unlimited” means there is no fixed monthly generation cap for ordinary human use of the app in a good-faith, non-abusive manner.

Fair use does not permit bots, scripts, scraping, programmatic bulk generation, industrialized content farming, account sharing, unauthorized resale, or other activity that is excessive, abusive, non-human, or materially harmful to the Service or other users. To preserve service quality, security, and reliability, VelociPost may apply reasonable technical protections, including rate limits, temporary throttling, cooldowns, verification steps, account review, or suspension where unusually excessive or abusive usage is detected.

These protections are intended to prevent abuse, not to restrict normal customer use. If access is limited in error, you may contact support for review.

5. User Inputs, Brand Assets, and Saved Content

You retain ownership of the text prompts, images, logos, creative directions, and other content you submit to the Service (collectively, “Inputs”), subject to any rights of third parties. You represent and warrant that you have all rights, permissions, and licenses necessary to use and upload your Inputs and to authorize VelociPost to process them.

You grant VelociPost a limited, non-exclusive, worldwide license to host, process, reproduce, modify, transmit, and otherwise use your Inputs solely as necessary to operate, secure, improve, and provide the Service, including generating outputs, rendering designs, saving your posts, syncing app state, preventing abuse, and providing technical support.

6. AI-Generated Outputs; Accuracy and Responsibility

The Service generates content using artificial intelligence. AI-generated text, layouts, images, recommendations, and designs may contain factual errors, hallucinations, omissions, inaccurate claims, outdated information, broken logic, formatting mistakes, biased language, or content that is infringing, misleading, offensive, or otherwise unsuitable.

VelociPost does not guarantee that any output is accurate, complete, lawful, unique, merchantable, fit for a particular purpose, non-infringing, or ready to publish. VelociPost is not responsible for inaccurate or problematic AI-generated content, including inaccurate pricing, dates, offers, disclaimers, claims, comparative statements, compliance language, or other business, legal, or factual statements generated through the Service.

You are solely responsible for reviewing, editing, fact-checking, clearing rights, obtaining approvals, and ensuring that any output you use or publish complies with applicable laws, platform rules, advertising standards, contractual obligations, and third-party rights. You should not rely on the Service for legal, medical, financial, compliance, safety-critical, or other professional advice.

7. Prohibited Uses

You may not:
(a) use the Service in violation of law or third-party rights;
(b) upload or generate content that you do not have permission to use;
(c) use the Service to create unlawful, fraudulent, deceptive, defamatory, harassing, abusive, or infringing content;
(d) attempt to bypass usage limits, rate limits, paywalls, access controls, or technical safeguards;
(e) use automation, bots, scripts, or other non-human methods to access or exploit the Service without written permission;
(f) interfere with, disrupt, probe, or compromise the security or performance of the Service;
(g) use the Service to compete with, benchmark, or build a substantially similar service without authorization; or
(h) share, transfer, or resell subscription access except where expressly authorized by VelociPost.

8. Intellectual Property

The Service, including its software, interface, branding, features, workflows, and underlying technology, is owned by VelociPost or its licensors and is protected by intellectual property and other applicable laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you by implication, estoppel, or otherwise.

Because AI-generated outputs may be influenced by your Inputs, model behavior, and other factors, ownership and protectability of outputs may vary by jurisdiction and use case. VelociPost does not provide legal advice regarding copyright, trademark, publicity rights, or ownership of outputs.

9. Availability, Changes, and Updates

VelociPost may change, improve, suspend, or discontinue any part of the Service at any time, including features, plan structure, usage limits, pricing, design workflows, storage behavior, or support channels. VelociPost may also release updates, patches, or modifications that are required for continued use, security, or compliance. Certain features may be available only on supported devices, operating systems, or app versions.

10. Privacy

Your use of the Service is also subject to the VelociPost Privacy Policy available at [insert Privacy Policy URL]. To the extent there is a conflict between the Privacy Policy and these Terms on privacy-specific matters, the Privacy Policy controls.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. VELOCIPOST DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE.

WITHOUT LIMITING THE FOREGOING, VELOCIPOST DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, CURRENT, COMPATIBLE WITH EVERY DEVICE OR PLATFORM, OR FREE OF DEFECTS, OR THAT GENERATED CONTENT WILL BE CORRECT, COMPLIANT, OR FIT FOR PUBLICATION.

12. Limitation of Liability

To the maximum extent permitted by law, VelociPost and its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, brand value, business opportunities, or content, arising out of or relating to the Service, even if advised of the possibility of such damages.

To the maximum extent permitted by law, VelociPost’s total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of: (i) the amount you paid to VelociPost for the Service in the 12 months before the event giving rise to the claim; or (ii) US$50.00.

13. Indemnification

You agree to defend, indemnify, and hold harmless VelociPost and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, losses, liabilities, damages, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your Inputs; (b) your outputs and how you use or publish them; (c) your violation of these Terms; or (d) your violation of applicable law or third-party rights.

14. Suspension and Termination

VelociPost may suspend, restrict, or terminate your access to the Service, with or without notice, if it reasonably believes you violated these Terms, created risk or legal exposure, engaged in abusive or fraudulent activity, or used the Service in a way that could harm the Service, its users, or third parties. Sections that by their nature should survive termination will survive, including sections relating to ownership, disclaimers, limitations of liability, indemnification, and dispute resolution.

15. Governing Law and Disputes

These Terms are governed by the federal laws of Mexico and, where applicable, the laws of the State of Baja California, without regard to conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be brought exclusively before the competent courts of Mexicali, Baja California, Mexico, and you and VelociPost consent to the jurisdiction and venue of those courts, except where applicable mandatory consumer protection law provides otherwise.
